If you’re going to sublet your home

Subletting requires approval from the board. An application for approval must be submitted in writing and must include the reason for the request, the period of time and the identity of the person who is to rent the apartment. The board can approve subletting for a maximum of 1 year. The board must be informed of any change of sublessee.
Don’t forget to submit a new application if you need to sublet for longer than one year. Be sure to notify the board of any change of address during the period of the sublet so we can contact you if necessary.

Legal entities / Rental agencies

Subletting to a legal entity or temporarily subletting your apartment through rental agencies such as Airbnb or equivalent is not permitted. Please note that the apartment owner is responsible for the apartment.

Subletting means that the tenant leases their apartment to another person who will use the apartment independently.

You must have the landlord’s consent in order to be allowed to sublet your apartment. This also applies if you lend the apartment to someone without charging them rent. Anyone who grants the use of their rental apartment without permission risks losing it.

If you only intend to grant the use of part of your apartment, for example a room to a lodger, you don’t need to ask the landlord for permission. This applies as long as the lodger is not going to use the apartment independently.

The primary tenant is responsible for ensuring that the rent is paid and that the sublessee conducts him or herself in an appropriate manner. In other words, the primary tenant may be given notice of termination if the sublessee disturbs the neighbours, for example. Read more on the Rent Tribunal website here.
